Take Action:”Republican Budget to Wolves: Drop Dead”, Section 1713 Passed!!

from page 266, Sec. 1713 of the House’s Continuing Resolution (passed 2/19/11).

SEC. 1713. Before the end of the 60-day period beginning on the date of enactment of this division, the Secretary of the Interior shall reissue the final rule published on April 2, 2009 (74 Fed. Reg. 15123 et seq.) without regard to any other …provision of statute or regulation that applies to issuance of such rule. Such reissuance (including this section) SHALL NOT BE SUBJECT TO JUDICIAL REVIEW.

This means that this bill throws out Judge Molloy’s ruling and states, “the Secretary of the Interior shall reissue the final rule published on April 2, 2009” – which was when Obama delisted wolves.

They buried the delisting rule in the text of the resolution, hoping no one would see it. Now, this Continuing Resolution goes on to the Senate. If they pass it, it is all in Obama’s hands for signature. If he signs it, the wolves of the Northern Rockies are back in the hands of the states for “management.”

PLEASE CONTACT ALL US SENATORS NOW – tell them you want Section 1713 of the House’s Continuing Resolution stricken from the bill!   Please consider cutting/pasting and/or modifying the letter below in “comments” to send to every member of the Senate.

Dear Senator —
As an wildlife conservation advocate, I am deeply disturbed by Section 1713 (p. 266) of the House’s Continuing Resolution – 2011 which was passed on Feb. 19, 2011. This… section states, “Before the end of the 60-day period beginning on the date of enactment of this division, the Secretary of the Interior shall reissue the final rule published on April 2, 2009 (74 Fed. Reg. 15123 et seq.) without regard to any other provision of statute or regulation that applies to issuance of such rule. Such reissuance (including this section) shall not be subject to judicial review.”

Please be advised that I vehemently oppose this section of the House’s version of the Appropriations bill. Buried deep within the text of the bill, it covertly voids US District Judge Donald Molloy’s ruling that returned wolves on the Endangered Species List as of August, 2010. In addition, Sec. 1713 seemingly precludes judicial review of any decisions related to de-listing the gray wolf from the Endangered Species List in the future.

It’s not the role of Congress to decide which species should or should not receive protection from the ESA. The ESA is one of our most respected environmental laws. Its power lies in the independent, scientific consultation at its heart. In fact, Congress has never successfully legislated a species-specific decision under the ESA. Wolves should not be the first. That is a decision that should be made by independent science. The ESA, and issues related to wolf restoration, requires clear thinking, strategic planning and science-based decision-making. To legislate such a decision would weaken the Act and set a dangerous precedent that could lead to more native fish, wildlife, and plants being wrongly stripped of protection.

Please don’t forget what the Republican controlled House Rules Committee is trying to do. They’ tacked a provision onto the Budget Bill that would strip gray wolves of their ESA protections in Montana, Idaho and parts of Oregon, Washington and Utah.

The anti-wolf crowd couldn’t win in court. Now they want to mount a sneak attack on the ESA by hiding this provision in a Budget Bill, shades of the Burn’s Amendment.

We cannot allow this to happen. Please sign the NRDC petition. Continue to call, email and write Congress to protest this underhanded assault on gray wolves. Politicians SHOULD NOT be meddling with the Endangered Species Act, in the name of political expediency.

TELL THEM TO STOP THESE SHADY TACTICS. WOLVES HAVE NOTHING TO DO WITH THE BUDGET.

Republican Budget to Wolves: Drop Dead

“Last night the Republican controlled House Rules Committee released a “continuing resolution” to fund the federal government past March.  As I thought, the bill contains cuts to funding for endangered species (for those of you following at home, see section 1704).  But it goes far beyond that.

The Committee has decreed, without a hearing and in defiance of the best and most up-to-date science, that wolves will lose all of their Endangered Species Act protection in Idaho, Montana, and parts of Washington, Oregon, and Utah (section 1713). The bill reinstates a plan that would legally allow states to kill all but 300 wolves in the Northern Rockies, a number that is not sufficient to sustain wolves over the long term. More than 1,700 wolves now roam the Northern Rockies.  That means those who support this provision are content to see as much as 82% of the population wiped out.

How is this possibly related to the budget of the United States of America?  When the Republican Party swept to power last November the repeatedly promised a new day–a day in which, among other things, budget bills would no longer contain extraneous policy provisions inserted to avoid the normal legislative process.  In their words: “We will end the practice of packaging unpopular bills with ‘must-pass’ legislation to circumvent the will of the American people. Instead, we will advance major legislation one issue at a time.” It looks like that new day doesn’t include wolves.

We need to fight this provision.  Stand up and be counted here.

  3. By next year and certainly by 2012 the American people will vote in douchebag Republican party out of office for good. People are already horrified how this party wants to take away people’s health care, take food away from mothers and their children, strip fuel assistance programs and job training programs as they vote in favor of tax cuts! We all knew that they could care less about clean water, air, global warming or Endangered animal protection! People are having major buyers remorse and now realize that elections have consequences. All the Democratic Senators are aware of these attempts to sneak in these bills- so I am not worried! The party of no ideas, small government unless it has to do with social programs is showing why they are not fit to lead!!!!!!

    • One can only hope William but I don’t see much difference between Dems and Reps, certainly not in the Northern Rockies anyway. And remember it was Obama that delisted wolves in the first place and Salazar is a Democrat. So I don’t have much faith is either party these days.

  4. Wha…wha…what?! I was going to say “You can’t just delist an endangered species just because you don’t like them”, but, I was wrong. Apparently, you can. Don’t let none of the pesky “science” get in the way.

    I am so utterly gutted… I don’t know. I wish I had something useful to suggest or say, but I can’t. I just feel utterly gutted. I was so hopeful something there in the States would happen that would put things back on track so in the UK we could point to it and say “It works there, and we can do it too”. I just can’t believe this…. it’s crazy…. As you say, it’s like Nabeki said…we’ve gone back 100 years.

    WHY?! Why do we have to do this? Why do we have to kill them? Humans and domestic canids are the typical example of a strong symbiotic relationship… Why are we killing their wild cousins? It’s so f*cked up…

William,I hope you are right but I take nothing for granted on what they say and what they do.I few days ago after Nabeki posted those other bad bills,I read that the president most likely will veto it,but from now and then,anything can happen.This is what I feared,a budget bill,a must pass situation,and no one wants the government to shut down.

    • Rita..We have to fight hard these next two weeks. Wolves don’t have much time. The budget bill has to be passed by March 4th or the government will shut down. The Senate isn’t even going to debate this until February 28th. We have to keep calling,writing and screaming to the high heavens. This cannot stand or no endangered animal will ever be safe. Now we know what it feels like to live in the the early 19th century.

  6. Pfew. Just got done e-mailing all 99 senators (one guy doesn’t have an e-mail form, apparently). Let’s hope it does any good at all.

    I, too, am becoming increasingly disillusioned with both political parties. When one party wants it to be legal to kill unborn human children, and the other wants it to be legal to kill animals for stupid reasons, you just can’t win.

The only thing we can do now is to yell loud and clear to our Senators. Enough is enough. We want this craziness to stop. It’s our turn to take the offensive. We must win this fight or wolves will be lost to us forever in the Northern Rockies.

  8. I just got this in an e-mail from the ASPCA:

    “The U.S. Bureau of Land Management (BLM) continues to mismanage the care of wild horses and burros. The agency’s current policies allow inhumane methods of gathering and confining equines, and could spell the end for these national icons. But there’s still an opportunity to help save our wild horses. U.S. Representative Dan Burton of Indiana has succeeded in passing an amendment to the Interior Appropriations Bill to cut $2 million from the BLM’s annual budget in order to pressure the agency to end its ill-conceived efforts.

    This amendment was adopted by the U.S. House of Representatives and will soon be considered in the Senate. Please let your two U.S. senators know that they should support the Burton amendment to cut $2 million dollars from the BLM’s budget—this cut saves money and our country’s wild horses.”

    • Thank you for the heads up captain sakonnna. I love the wild horses, I wish had a blog for them, for the bison, for the grizzly . So many animals that need our help. I couldn’t believe this statement from the article. This is the awful woman from wy. that tried to include wy. wolves in the budget bill:

      “One vocal opponent of the amendment is Rep. Cynthia Lummis, R-WY. “It is Congress that has caused the problems by saying we cannot slaughter horses, yet we are not supposed to keep them in pens,” she stated. “We are supposed to allow them to overgraze the West.”

      What the hell is she talking about? At most there are 25,000 wild horses left in the wild while over 100 million cattle are trampling our prairies and wild lands. That has to be the nuttiest thing I’ve heard in a long time and it shows you the half truths and propaganda these people like to spread. Nobody challenges these ridiculous statements. Despicable.

      I’ll put do a post on the wild horses soon but I want to keep this post up on the wolves because they are in imminent danger of being slaughtered.

    Wolf has had the audacity to continually defy dominion, a constant reminder that mankind can not conquer all. Arrogance refuses to accept him, and obstinence will never listen to reason.

    Unjustly, society has embraced the practice of culling what they find inconvenient or expendable…and the Wolf is both to those who seek his demise.

  11. Every Senator that I called this week said they are getting MANY calls from concerned people. These anti-wolf people are dangerous to our democracy. To think they can slip a few sentences in a bill and turn Envoronmental protection on it’s ear show’s how devious they are. I read some of the comments that white wolf posted on the trapshooters message. It was interesting when one of the idiots said “Now if only we could get hawks delisted”!!!!
    People need to call Sen Reid’s office, he is the person that I am concerned about. CALL

  12. Is there really 1700 wolves now? Hasn’t that number gone down? This past autumn and winter I am sure many wolves were killed but no one is keeping track anymore of their numbers. Yet, the 1700 number is continually thrown around.

      Who knows what the true number is. As you said there have been many wolves poached. This is the number that’s quoted, it’s probably much lower. They rely on hunter counts, wildlife services and the state game agencies. Do I trust these counts? No.
