Montana Governor States He Will Defy Federal Protections For Gray Wolves….

Backtracking?? Looks like Montana FWP is trying to defuse the mess the Governor unleashed yesterday?

“Gov. Brian Schweitzer’s statements notwithstanding, Montana’s wildlife wardens aren’t preparing for war on wolves any time soon.

On Wednesday, Schweitzer announced he was done waiting for federal permission to manage wolves in Montana. He encouraged ranchers to kill wolves that prey on livestock throughout the state, including the northern portion where federal rules prohibit that. He also said he wanted Department of Fish, Wildlife and Parks officials to start killing wolves that threaten elk herds.

On Thursday, FWP spokesman Ron Aasheim said the department was still pursuing a formal request to shoot some wolves in the Bitterroot Mountains, but did not have larger plans.

That involves what’s known as a 10-j petition to the U.S. Fish and Wildlife Service to manage wolves that are still protected under the federal Endangered Species Act. It would only apply to an area of the Bitterroots along the Idaho border where elk populations have fallen sharply.

Fish and Wildlife Service spokesman Chris Tollefson said on Thursday that application was still under review.

“It continues to be a high priority for us, and we continue to proceed on it,” Tollefson said of the 10-j application. “We expect to have a draft decision available within the next six weeks.”

Schweitzer also encouraged livestock owners throughout Montana to defend their animals against wolves, including those in the northern half of the state. While wolves south of Interstate 90 are considered part of a “experimental, nonessential” population that was transplanted in Yellowstone National Park in the 1990s, the packs north of the freeway naturally migrated down from Canada and have a higher level of protection. Ranchers are allowed to shoot threatening wolves in the southern zone, but are not supposed to harm those in the north.

Aasheim said that after Schweitzer’s announcement, FWP wardens would continue monitoring wolf populations and activity, but would not be investigating livestock depredations in the northern zone.

“The Fish and Wildlife Service will have responsibility for any prosecution in those cases,” Aasheim said. “North of I-90, Montana wardens will not be involved in cases where livestock producers kill wolves.”

This is just getting more horrific as the days go by. Now the Governor of Montana is going to defy wolves ESA protections and shoot wolves that “have been hurting elk herds?”  So in other words wolves will be killed for eating!! And this is the state that wants to “manage” wolves. This is scary!!

What message is the Montana Governor sending? That it’s alright to obey some laws but not others? That it’s OK to defy federal law, if it’s inconvenient?

The claim he’s protecting Montana cattle ranchers from wolves is ridiculous.  Out of 2.6+ million cattle in Montana, wolves were responsible for 97 cow losses in 2009. That’s it, 97.  Yet ranchers lose thousands and thousands of cattle due to disease, weather and reproduction every year. Coyotes are the main predator of cattle yet those numbers are also tiny. I defy anyone to tell me 97 cattle losses, out of millions of cows,  is an emergency.

I think this is a calculated move to keep the pressure up on wolves. There are so many anti-wolf bills in Congress right now, they are being printed faster than money. I really hope this action by the Governor backfires and finally opens people’s eyes to the persecution wolves are suffering under. To blame wolves for eating elk, which is their natural prey, just to save them for a hunters bullet, rings hollow. What is the next move in this sorrowful game of chess being played with the lives of wolves for political expediency?

Dear Secretary Salazar:

I write to you today regarding wolf management in Montana.

While almost everyone acknowledges that the Northern Rocky Mountain gray wolf population is fully recovered, as the Governor of Montana I am profoundly frustrated by the lack of any actual results that recognize Montana’s rights and responsibilities to manage its wildlife. Montana has for years done everything that has been asked: adopting a model wolf management plan; enacting enabling legislation; and adopting the necessary implementing rules. Our exemplary efforts have been ignored. I cannot continue to ignore the crying need for workable wolf management while Montana waits, and waits, and waits. Therefore, I am now going to take additional necessary steps to protect the interests of Montana’s livestock producers and hunters to the extent that I can within my authorities as governor.

First, for Montana’s northwest endangered wolves (north of Interstate 90), any livestock producers who kill or harass a wolf attacking their livestock will not be prosecuted by Montana game wardens. Montana Department of Fish, Wildlife, and Parks (FWP) wardens will be directed to exercise their prosecutorial discretion by not investigating or citing anyone protecting their livestock.

Further, I am directing FWP to respond to any livestock depredation by removing whole packs that kill livestock, wherever this may occur.

Still further, to protect the elk herds in Montana’s Bitterroot Valley that have been most adversely affected by wolf predation, I am directing FWP, to the extent allowed by the Endangered Species Act, to cull these wolves by whole-pack removal to enable elk herds to recover.

  2. You hit the nail on the head with the comment about wolves being demonized for simply eating their natural prey- and saving elk from wolves just so they can be killed by a hunter instead. This MT governor is following what Idaho’s Governor did, but a little worse i think. I am hoping that it will be awful enough to gain some attention to our cause! Lord only knows why nothing has been awful enough yet!

    • Ann… I’m constantly amazed how the haters have been able to spread such myths about wolves and get away with it. They all know there is no crisis, wolves aren’t eating all the elk and they certainly aren’t even in the running for being a big threat to livestock. But facts are pesky little obstacles to myths and lies. So they just ignore them and keep ranting and raving like spoiled children that want their way. The war on wolves is escalating. The haters have found their whipping boy they can blame for all their shortcomings. Many of these people have never and will never see a wild wolf in their lives. It’s just a way to stick it to the feds and make themselves feel important.

      To blame wolves for eating elk, their natural prey, to threaten to kill whole packs for it, just so a hunter can come along and kill an elk is beyond the pale. I truly am at a loss for words tonight.

  3. I seem to be starting everyday with “I can’t believe this”. I can’t. I though I would never say anyone was worse than Otter but I believe you are right Nabeki. He is worse than Otter. Do you know if Western Watersheds or the Center for Biological Diversity, or anybody for that matter, is filing an injunction, a lawsuit? So are we supposed to allow total anarchy? Governor Schweitzer can just decide what laws he is going to obey? Again, I don’t know what to say other than I am stunned and speechless.

    • I’m with you SCWG…..just when I think I’ve seen it all, it gets worse. I don’t think this was a random move though. I believe it was calculated to keep the pressure on wolves. Maybe the 9000 anti-wolf bills aren’t moving fast enough for the governor. This certainly needs a response, unless there is a set of rules that are allowed to be broken for political expediency?? Where is the USFWS? They’re in charge of wolves. Are the going to let the state of Montana kill wolves protected by the ESA?

      And doesn’t this make the point that wolves absolutely cannot survive without the ESA? Heck the law was tailor made for them. I can’t think of a species more deserving of it’s protection. It’s not just about how many wolves there are but can they survive in this atmosphere of hate. The answer is no. Maybe in fifty years but not now.

    You folks have to be blind. The moose & elk numbers around Yellowstone are in complete collapse! I have 11 moose points to hunt in Wyoming and I can’t draw my tag because each time I apply WYG&F has to drop the quota due to wolf predation. I have invested and waited 12 years to kill my moose. I had to switch unit choices the last 3 straight years moving southward from unit 20 to 23 to 26, away from the wolves. These are less desirable trophy moose units each year. I’m running out of room people! Only one unit to the Colorado state line!

      Not sure where you got the idea the elk belong to you but guess what, they don’t. Ungulate numbers rise and fall, you know why, it’s called nature, read about it.

Oh but wait, there are almost 400,000 elk in the tri-state area of Montana, Idaho and Wyoming.

        Zim, I just wanted to add one little fact here. You may have noticed that not as many elk are seen as in past years before wolves (even though aerial counts have proved otherwise), but there’s a reason for that, and its very simple: predator-prey relationships.
        Before the re-introduction of wolves to Yellowstone in 1995, elk were alert only about 5% of the time–we could say they were literally behaving like cows. They stayed on one place for a long time, and entered aspen, willow and cottonwood woods without the slightest fright. They had no predators to worry about, therefore being very easy to hunt. This, however, was a disaster for the surrounding eco-system.
        Wolves, being apex predators, were gone. Elk populations flourished. Aspen, willow and cottonwood trees were diminished. These provided critical songbird and beaver habitat and supported marshes. All these were severely affected. Bears, coyotes, bald eagles, corvids (crows, ravens and jays), foxes and other carnivores who sometimes relied on wolf kills were affected, too.
        Coyotes, important pronghorn antelope fawn predators, flourished, therefore causing a decline in pronghorn populations.
        As you can see, everything is connected. The removal or diminish of an important part of the food chain has many consequences. You must think outside of your hunting preferences, and think of eco-systems work.
        After the re-introduction of wolves, elk were alert 75% of the time. Now they were behaving like real elk! They grazed and moved, grazed and moved instead of staying in one place. They were very alert to danger, running on the slightest suspicious sound. They stayed away from aspen, willow and cottonwood forests, therefore letting eco-systems there to recover. Bear and pronghorn antelope populations rised.
        In summary, the re-introduction of one apex-predator affected every part of the ecosystem, and hunters should understand wolves and nature if they want us to believe that they’re “true conservationists”.

    • Sorry Zim, but I think you’re pretty selfish if all you care about is the fact that wolves might be ruining your chance to bag a trophy moose. You don’t need that moose, and in my opinion, any thrill you might get out of killing it is not worth the life of even one wolf. You have the option of finding different food sources; they don’t. Leave them alone and get your entertainment somewhere else.

      Besides, even if we got rid of all the wolves, there is no guarantee moose populations would rebound to your satisfaction. There are other factors that influence how many moose there are, habitat and food availability in particular. Moose habitat in Yellowstone has not been particularly favorable in recent years, due to severe forest fires and so on. If they don’t have enough food, the shortage will impose a cap on the population, regardless of how low predation rates are. Keeping the population artificially high by removing predators could even lead to habitat stress and damage, making the area even less favorable for moose in the future. And let’s not forget that grizzly bears eat moose too; I don’t hear you blaming them for anything, though. Guess what else? Moose populations in the Centennial Valley have been doing fine, in spite of the wolves that have ranged there. You’re totally jumping to conclusions by scapegoating wolves as the primary cause of moose decline.

      As for elk, even if wolves are causing some *local* declines, there are still more than 100,000 elk in your state, as Nabeki pointed out. Plenty for people to hunt if they’re really willing to put in the effort to go looking for them.

      • All they care about is their trophy while wolves hunt for survival. How selfish and greedy can you get? The problem is hunters think they own wildlife, they do not. The non-hunters greatly outnumber the hunters. We should be the ones “managing” wildlife. Why should a minority be allowed to dictate what wildlife should live and what wildlife should die?     First of all, we should kill every darn wolf that kills cattle. No, wait, we should wipe out THEIR WHOLE DARN PACK (which is wolf-talk for family) so that those fur balls don’t go killing our livestock anymore. Who cares about helping ranchers use sustainable predator barriers? Who cares about teaching them how to live in harmony with their surroundings? We should waste our taxes in shooting/poisoning/trapping those howlin’ devils till we have just a few isolated packs (we must be careful about this, though. A few hundred more wolves and their back in that stupid ESA).
    Second, we must also shoot ’em because they kill our elk. Tell ya’, in a few years they’ll wipe out every single elk in the West and then will turn their lousy snouts to our children and pets.
    Plus, they ALWAYS kill for fun. They are a bunch of blood-thirsty pests we must cull or else they’ll start attacking people and pets by the hundreds.
    Who cares about biology, ecology, sound-science, ethics, prey-predator relationships and sustainable farming? The answer is simple: Smoke a pack a day.

Didn’t hear any of you wolf haters complaining then. There are so many deer in Northwestern Montana I can go to Glacier National Park and trip over them in the camp grounds.

  12. Let wolves be managed by the states, and let the people in those states, by voting, decide how to manage their wolf populations. You wolf extremists want to be ran by the feds. This country is a democracy last time I checked the people in the states can decide.

    • Actually, this country is a republic, not a democracy. The people usually don’t vote on matters directly; we vote through our elected representatives. This is partly for convenience, but there’s another reason too — the elected officials of the government are supposed to serve as a CHECK on the PEOPLE! While many of the structures in our government are designed to keep government from becoming oppressive and restricting our freedom, the government was also intended to restrain the passions of the mob and keep us from rushing headlong into things that we would eventually come to regret. According to James Madison (probably — it may have been Hamilton or Jay), “… such an institution [as the federal Senate] may sometimes be necessary as a defense to the people against their own temporary errors and delusions.” And Alexander Hamilton wrote, “Why has government been instituted at all? Because the passions of men will not conform to the dictates of reason and justice without constraint.”

      Furthermore, why do we even have a federal government? Why is there a bill of rights in the Constitution? Why don’t we let the people of each state decide whether cruel and unusual punishment, or unreasonable search and seizure, or trials without a jury, should be legal within that state? There are certain basic matters of justice that are worthy of being addressed on a national level, and in my opinion, this is one of them.

    • John…everyone knows the catch word for kill is “manage”. The majority of people do not want wolves “managed”. The majority of hunters maybe, not the same thing. You live in your little bubble where everyone hates wolves. Well guess what, wolves are loved all over the world, unfortunately our wildlife is being held captive by state game agencies, who make money off hunter’s licensing fees. State game agencies should never be allowed to manage predators because there’s a conflict of interest. These agencies keep ungulate numbers inflated to satisfy the hunting lobby and won’t tolerate competition from predators, who are much better at keeping game herds healthy then hunters.

  13. Marshall law is all the esa is. Now that the wolf population has been establish to the quota that was set turn it back over to the voters in this country! That elected governor in Montana is doing what the people of Montana voted him in their to do. The majority of people that live here in the west do not want wolves. And if I’m wrong then our democracy will show that. Turn the power back to the people.

    • I like states’ rights and all that, but with rights come responsibility. You only want power so that you can abuse it. The western states could probably be managing their own wolf populations right now if they were willing to do it with a sense of responsibility and compassion, but no. Instead they insist on killing as many as they think they can get away with, in the name of hunters’ entertainment and ranchers’ wallets.

      And by the way, I live right here in Montana — so don’t start about how I’m an oppressive East Coast liberal.

    that the animal kingdom(including wolves)have been here on Earth, long before humans entered the picture.
    The Great Spirit put wolves here on our Mother Earth
    for a reason and that’s to bring balance to the ecosystem and if our animal kingdom disappears from
    out world forever, so will the entire human race!!!
    Among other things, wolves play a very important
    to the Native Americans’ spirituality and if you
    @#%&!!! shallow-minded redneck yahoos goin’ around
    killing off these beautiful creatures, then you’re
    violating their spiritual rights, ’cause wolves,
    buffalo, bears, eagles, and other wildlife,
    is very sacred to the American Indian culture!
    And there’s something else I think you should also
    take into consideration…
    If you you’re gonna proceed with these barbaric
    acts of wiping wolves off the face of this world,
    there would also be a serious backlash!
    Students may not want to attend college here,
    nor tourists want to visit or drive through Montana.
    Instead, there would be a major boycott from near and far, and Montana would suffer economically, and tourism jobs would be lost, due to the boycott, all because of a mere handful of wolf-hating redneck yahoos who want these sacred furry creatures hunted to extinction..
    And from the eyes of the Almighty,
    you would forever be put to shame!!!!
    I REFUSE to support the wolf kills!
    I don’t care if ya’ put your guns to my head
    and assassinated me, ’cause I’m not afraid of
    sacrificing my life to protect these beautiful animals, and on top of that, the like-minds would revere me as a martyr, while you @#%&!! skullywags sit in jail awaiting trail for my murder!
    And be very afraid, ’cause my spirit will haunt you to the ends of the Earth, if I was shot and killed!
    So, if you’re gonna take shots at wolves,
    ya’ better kill me first!…
    That’s if ya’ got the guts and balls to do som
    ’cause I doubt that you will, ’cause you’re afraid of being haunted by my ghost, while you’re sittin’ in a jail cell, awaiting trail!

    • wizard of hamilton…I can feel the passion in your words. Wolf advocates just have a love for this animal. It’s something about wolves that touches our spirits. Thank you for sharing that with us. If only we didn’t have to contend with the backward thinking anti wolf group who seem to be living in 1910 or 1891 as you said.

  16. my husband’s grandfather said that during the great depression you found out who the real people were and who were the lowlifes were, very quickly and easily. I think in this great recession were seeing the same thing. Were seeing the govenor cast off his sheeps clothing and showing the real wolf in him. I think he just politcally castrated himself. unless all the ranchers and hunters, and wolf haters bail him out.
    i wonder what the statistics are of the above mentioned jerks compared to the people who care???

  17. Seems like the govenor actually is empowered by the federal government since 1975 through the State Preparedness Act. In Idaho code 46-1002(3) defines an emergency” as the occurance or imminent threat of widespread or severe damage, injury, or loss of life or property resulting from and natural or manmade cause”. He’s declaring Marshall Law on the wolves, with the permission of the federal government.. via state of emergency.
    Somebody hired good lawyers, I still think it’s large quantities of BS. How are we going to stop these people,people?
