Environmental Groups Will Sue Over Constitutionality Of Wolf Delisting Rider..

Wolves are going back to court and what terrific news this is.

Alliance for the Wild Rockies, Friends of the Clearwater and WildEarth Guardians plan to file a lawsuit in US District Court, challenging the wolf delisting rider on Constitutional grounds.

Mike Garrity, Executive director of AWR, states: “We believe the wolf delisting rider violates the separation of powers in the U.S. Constitution.”

The three groups are being represented by Jay Tutchton, environmental law attorney.

Wolf advocates have felt powerless to help wolves  since the wolf delisting rider was slipped into a must pass appropriations bill by Senator Jon Tester (D-MT) and Rep. Mike Simpson (R-ID). The budget bill was passed by the Senate with the wolf rider intact and signed into law by President Obama on April 16th, 2011. The USFWS had 60 days from that date to publish the final rule and it was announced yesterday, in the Lewistown Chronicle, that they intend to so this week.

“Wolves will be delisted in the Northern Rockies except Wyoming on Thursday, Interior Secretary Ken Salazar said.

Please give generously to these environmental groups that are standing firm with wolves and are willing to go to court to defend them once again.

It was reported on the Wildlife News that Western Watersheds Project also expects “to file litigation challenging the wolf delisting rider.”

  2. I have found out that Whole Foods purchases some
    beef from Idaho and Montanta. They primarly purchase from Colorado & California, but also from the two mentioned states. I called the Headquarters in Austin,TX asking about this…they have not responded.

    I am asking for a boycott on any grocer continuing to buy/sell beef from Idaho/Montana.

    I also have a list of several film stars who are
    avid animal supporters…am contacting them to see if any of them (or all) will champion the Gray Wolves.
    (Stay posted). All companies in Idaho & Montana are being notified that their company’s products are also being banned by the rest of the world.

    Grocery stores who do not purchase beef from Idaho or Montana have been asked to advertise the fact.

    At this time, not only has the Idaho/Montana wolves been targeted (arial shooting will begin very soon) but the Western Great Lakes Gray Wolves will be next.

    Having spent 30 minutes in Michael Bean’s office in DC, who is in charge of the Gray Wolves,(Office of the Interior) some three weeks ago, I am
    totally disgusted with our Interior Secretary and his
    staff. I do believe that Obama will replace them prior to his re-election (in order to gain conservative votes…but the wolves will be gone by that time….next on the list, Mexican Wolves.

    • Sandra that is a great idea. I just posted on NIWA’s FB page, that IMHO, the ranchers are the ones we need to really target. Not that hunters aren’t the scum of the earth in my book, but it’s the ranchers that kill our wildlife with subsidies of our tax dollars. I don’t have a Whole Foods near me, but I am going to make it a point to speak to Trader Joe’s and Henry’s who are big here in North County San Diego, where I live, as well as our local grocery chains. I have asked friends at work when going out to lunch and they order beef to change their order. Of course they ask why and I tell them. I have no way of knowing what they do in their own homes, but most people will now not order beef if I am there because they don’t want a lecture. I don’t care.

    • Awesome Sandra, way to go!! I just finished my project to fax the petition for our boycott to the Governors of both states and also to companies in Idaho and Montana to let them know that there is a boycott now in effect for their state…also to remind them the entire world is watching.

      Keep fighting the good fight. We can do this.

    • Great research Sandra. I’m going to have the boycott petition up on WW today. Between the lawsuits and the boycott maybe we can bring some real heat to these wolf hating states. They are shameless.

      Obama is solely responsible for putting a rancher in charge of the Interior. He could have appointed someone like Patrick Kennedy but no he wanted to score points in the red states. Well he has pissed off his base and made life a nightmare for wolves in the Northern Rockies. The democrat party has lost me forever. I’d rather write the name of my dog on a ballet then vote for another Dem. We need a real third party, one that respects the lives of animals. Maybe all this grass roots energy for wolves will be the start of something.

    After reading your earlier post today that Salazar was issuing his decree to start taking down the wolves and Idaho’s aerial shooting plans I was an emotional wreck. But then I got my act together and wrote to my governor to put pressure on Obama and finished another letter to Obama. This afternoon I felt a ray of hope from somewhere…..and here it is. Everybody just keep praying, sending letters, signing those petitions that come our way!

    • I’m elated too Barbara. Finally some movement, we’ve all been literally stunned since the 81 Senators sold out wolves live on Cspan. Now we have some push back. I know the three groups have a great attorney so lets all donate to them to keep this soon to be filed lawsuit going. We finally have out White Knights. Now we need a celeb that will lend their name to this cause.

    • Isn’t that an awesome pic g..? What a beautiful wolf. Maybe it’s an elk bone or could be a stick. Either way wolves were put on this earth to keep ungulate herds healthy, that’s why we have predators. Unfortunately we have to deal with the most deadly predator of all, man. The wolf is a cupcake compared to them.

  13. Update — Friends of Animals today filed a Motion to Intervene in the Alliance for Wild Rockies et al v Salazar case.

    Friday, May 27, 2011 Friends of Animals filed a Motion to Intervene in the case Alliance for the Wild Rockies v. Salazar, which challenges the constitutionality of Section 1713 of the Department of Defense and Full-Year Continuing Appropriations Act of 2011, P.L. 112-10 (also called the “budget rider” or the “wolf rider”). The budget rider directed the USFWS to reinstate the 2007 wolf delisting rule, which removed gray wolves in all areas of the Northern Rocky Mountains Distinct Population Segment (DPS) from protection under the Endangered Species Act. The original complaint was filed by Alliance for the Wild Rockies, Friends of the Clearwater and WildEarth Guardians on May 5, 2011 and the case was recently consolidated with another case, Center for Biological Diversity v. Salzar. The complaints challenge constitutionality of this legislative enactment.

    • What great news Priscilla that Friends of Animals is joining the lawsuit since we’ve heard that SCI, NRA and others are trying to jump onto the lawsuit for the other side.
