Finally I have good news to report! Wyoming wolves have regained their federal protections! Thank you Earth Justice!

Victory: Federal Judge Reinstates Federal Protections Statewide

Washington, D.C. —

Federal protections for gray wolves in Wyoming were reinstated today after a judge invalidated the U.S. Fish and Wildlife Service’s 2012 statewide Endangered Species Act delisting of the species. The ruling from the U.S. District Court halts the management of wolves by Wyoming, a state with a history of hostile and extreme anti-wolf policies.

“The court has ruled and Wyoming’s kill-on-sight approach to wolf management throughout much of the state must stop,” said Earthjustice attorney Tim Preso. “Today’s ruling restores much-needed federal protection to wolves throughout Wyoming, which allowed killing along the borders of Yellowstone National Park and throughout national forest lands south of Jackson Hole where wolves were treated as vermin under state management. If Wyoming wants to resume management of wolves, it must develop a legitimate conservation plan that ensures a vibrant wolf population in the Northern Rockies.”

Earthjustice represented Defenders of Wildlife, Natural Resources Defense Council, the Sierra Club and the Center for Biological Diversity in challenging the Fish and Wildlife Service’s September 2012 decision to strip Endangered Species Act protections from gray wolves in Wyoming. The conservation groups challenged the 2012 decision on grounds that Wyoming law authorized unlimited wolf killing in a “predator” zone that extended throughout most of the state, and provided inadequate protection for wolves even where killing was regulated.

“Today the court affirmed that delisting gray wolves in Wyoming by the Obama administration was premature and a violation of federal law,” said Defenders of Wildlife President and CEO Jamie Rappaport Clark. “Any state that has a wolf management plan that allows for unlimited wolf killing throughout most of the state should not be allowed to manage wolves. Wolves need to remain protected under the Endangered Species Act until the species is fully recovered. State laws and policies that treat wolves like vermin are as outdated and discredited today as they were a century ago.”

“The decision makes clear that ‘shoot-on-sight’ is not an acceptable management plan for wolves across the majority of the state,” said Dr. Sylvia Fallon, senior scientist and wildlife conservation director at the Natural Resources Defense Council. “It’s time for Wyoming to step back and develop a more science-based approach to managing wolves.”

“The court has rightly recognized the deep flaws in Wyoming’s wolf management plan. Wolves in Wyoming must have federal protection until the state gets it right. That means developing a science-based management plan that recognizes the many benefits wolves bring to the region instead of vermin that can be shot on sight in the majority of the state,” said Bonnie Rice of the Sierra Club’s Greater Yellowstone Our Wild America Campaign. 

“We’re thrilled that protections for Wyoming’s fragile population of wolves have been restored,” said Noah Greenwald, endangered species director with the Center for Biological Diversity. “With Wyoming allowing wolves to be shot on sight across more than 80 percent of the state, there is no way protections for wolves should have ever been removed.”

The 2012 delisting of wolves in Wyoming turned wolf management over to the state, which opened up over 80 percent of its land to unlimited wolf killing and provided weak protections for wolves in the remainder. Since the delisting, 219 wolves have been killed under Wyoming’s management. Prior to the 2012 reversal of its position, the Fish and Wildlife Service denied Wyoming the authority to manage wolves in the state due to its extremely hostile anti-wolf laws and policies.

Background: There were once up to 2 million gray wolves living in North America, but the animals were driven to near-extinction in the lower 48 states by the early 1900s. After passage of the federal Endangered Species Act in 1973 and protection of the wolf as endangered, federal recovery programs resulted in the rebound of wolf populations in limited parts of the country. Roughly 5,500 wolves currently live in the continental United States — a fraction of the species’ historic numbers.

The U.S. Fish and Wildlife Service is currently proposing to remove Endangered Species Act protection for most gray wolves across the United States, a proposal that the groups strongly oppose; a final decision could be made later this year.

    • Connie…This is a great victory for Wyoming wolves. The lawsuit has been going on for several years and it was able to be prevail because the “no judicial review clause”, that was attached to the wolf delisting rider, passed by Congress in 2011, did not apply to wolves in Wyoming, although Wyoming politicians tried their hardest to pass a version of it. So finding relief in the courts for wolves in Montana and Idaho has been blocked. The only way to fix this is for advocates to pressure Congress to overturn the rider and allow the delisting to be challenged in the courts, which sadly there seems to be little impetus for. I’ve talked about this until I’m blue in the face, I’ve posted the names of every single Senator who voted to delist wolves, yet almost four year later they haven’t been held accountable. Hopefully many of them who are up for re-election in November will be voted out of office. So Idaho and Montana wolves are stuck in a horrible situation that can’t be challenged in the courts and can only be changed by Congress. The only thing that could change this is if Montana or Idaho dropped wolf numbers below 150, which Idaho seems to be trying to do. Then USFWS could step in and re-list the wolves.

      The Obama administration and Senate Democrats abandoned Idaho and Montana wolves to their enemies, so they could hold onto their Senate majority by getting Jon Tester re-elected, that’s the maddening truth.

      • Tena, here’s the list of Senators who voted to delist wolves. The Democrats are in bold. I also added a link to a post that explains how this all came about and includes the attempted “compromise” by 10 of the environmental groups to head off a Congressional delisting by agreeing to allow Montana and Idaho wolves to be “managed” by the states. It was an awful move, because Judge Molloy had relisted wolves in the Northern Rockies in 2010 and now these 10 groups were asking him go against his own decision. Many people either don’t know about this or have forgotten. Things were not pretty in 2010/2011. The end result is Molloy rejected “the compromise” and the Senate delisted wolves in the Spring of 2011 in the budget bill rider fiasco. The language reads: : “[T]he Secretary of the Interior shall reissue the final rule published on April 2, 2009. … Such reissuance … shall not be subject to judicial review.”

  5. Gray Wolf and Sportsmen Conservationists
    The wildlife agencies, state and federal, do what they want and call it science and conservation. Sporting groups do the same, such as the Safari Club and Rocky Mountain Elk Foundation. Montana FWP had sporting groups compete for bids on big game tickets, an auction. FWP calls them conservationists. They call themselves conservationists. The emphasis of these sporting groups which FWP goes along with and USDA Wildlife Services facilitate and USFWS supports is game farming which is bad news for predators because these groups and wildlife agencies buy into the folklore that in order to have plenty of game to kill, such as elk, then the predators have to be managed and minimized. I listened to an outfitter talk one day about wolves to a young Elmer Fudd Nimrod for about a half hour and it was pure folklore and villainization. The sporting groups will call for predator management in an area because they believe some localized elk population is down and in come the cavalry of management services to cull the predators. Usually, waxing and waning of say an elk population is over hunting, forage, weather, normal movement, but it is evident what is running the show of wildlife management (mismanagement) is hunter-trapper-rancher folklore, lies, myth, parochial ignorance and self-centered power and control. This wildlife agency-hunter-rancher unholy alliance is what the gray wolf is up against and what the real conservationists are up against. The wildlife agencies and sporting “conservationists” really do not understand the wolf and wildlife ecology.

  8. God bless you Earth Justice and all those who you represented. We still have a long hard battle in front of us, but a giant step has been made on the wolf’s behalf. May there be many more large paw prints in the right direction. I only wish that these states would realize, the wolves do not need to be ‘managed’…the politicians do.   9. Wolf “management” by state wildlife agencies is a political management fiasco. The crux of the problem, I think, in Midwestern and western states is that the state wildlife agencies are too wedded to hunters and trappers in game management, too wedded to license fees, and essentially too much alike in their thinking and values. If you put hunters, trappers, and most wildlife officials in the same room, you could not tell one yokel (redneck) from another. To them animals are recreational killing opportunities with the added benefit of game meat, fur, or trophies. They are generally hateful of predators, especially the wolf, and regarding the wolf they buy into the folklore, lies and myths about game herd decimation and the need to minimize them so that they can game farm for more recreational killing opportunities. None of them, including the state wildlife agencies see the value of wolves and predators in a healthy balanced ecology that benefits all including their ignorant butts. The value of wildlife viewing, monetary and aesthetic, is lost on them, they in their self-centered way, do not care. The challenge of conservation organizations, if we are to have a balanced representation of predators, i.e. the wolf in these states, is to realign wildlife viewing dollars and tourism into state wildlife agencies and overshadow hunting licences. The basic challenge is how do we get state wildlife agencies to manage wildlife and wilderness in a balanced way with a primary emphasis on wildlife and habitat rather than game farming for hunters and encroachment by ranchers and farmers on public land. We need to make public over and over again the barbarism of hunting, game farming, predator persecution by hunters and state game agencies, and the total barbarism of trapping. The public is largely ignorant and unfortunately way too indifferent.

Check out our recent post (Campaign for Yellowstone’s Wolves on FB) or carefully read the ruling. It was very narrow, it certainly seems. So, we are all going to have to fight harder to build public support and mobilization for ending unjust state “wolf management.”

  20. This is the best news that I’ve read about in a long time – perhaps the best news ever since I got involved with the Wolf Wars back in April of 2011! This is fantasic, I cannot express in words how happy and relieved I am that gray wolves in Wyoming are protected once again! Now I can rest at night knowing that wolves in Wyoming are not shot on sight as vermin anymore!

    Now lets work together to get the wolves in Idaho and Montana relisted!

Oh, that the rest of the nations wolves could be saved through Federal protection under the Endangered Species act….permanently. My hope also is in the saving of the wild mustangs and burros from the BLM. Do not be lulled into a sense of well-being by any of this long-awaited good news….WE MUST BE ON CONSTANT VIGIL AND CONTINUE THE WORK!

  34. This is a good start …but , The American people need to see the horrors being carried out by OUR own government at federal and state levels. People we need this to STOP now! OUR wolves and wildlife can’t take any more of this devastation. So I suggest We start calling and writing them to make them SPEAK UP for OUR animals in the wild. There should be massive TV ads running at prime time hours everyday and newspaper ads taken out half to full page sections run daily(weekly at the least) ,billboards on major corners or cities , big celeb names speaking out, talk shows and that would be a good start. WE need to tell everyone of the lies and greed that are slaughtering these precious animals . Along with exposing these government agencies that kill millions each year in the name of management. The apathy that is in this country and worldwide is ,for lack of better words is appalling and needs to change now or WE will loose the wild animals that we love so dear to hunting , ranching , Big oil ,timber,mining and political officials that were bought off by them . These lands were put aside to save our wildlife and wilderness ,not to be used or sold off to line the pockets of the rich and greedy ! ~~~ WE NEED TO UNITE AS ONE, TO FIGHT AS ONE TO SAVE THEM ALL ~~

  38. This is great news!

    The delisting of wolves in Wyoming was purely political. WY Senator Barasso was holding up Dan Ashe’s appointment as USFWS Director, so former Interior Secretary Salazar met with Gov. Meade and agreed to delist wolves in the state in exchange for Ashe’s appointment. Talk about corruption and a lack of ethics!

    Now if we could only get federal protections restored for wolves in Montana and Idaho! I agree that mainstream environmental groups should be pressuring Congress to over-turn that despicable rider, but unfortunately, these groups don’t seem to have the will for such a fight.

    I for one will never vote for my Dem Senators again, and I let them know it as soon as they agreed to that rider.
