Federal judge: Great Lakes wolves return to endangered list

TRAVERSE CITY, Mich. — A federal judge on Friday threw out an Obama administration decision to remove the gray wolf population in the western Great Lakes region from the endangered species list — a decision that will ban further wolf hunting and trapping in three states.

The order affects wolves in Michigan, Minnesota and Wisconsin, where the combined population is estimated at around 3,700. The U.S. Fish and Wildlife Service dropped federal protections from those wolves in 2012 and handed over management to the states.

U.S. District Judge Beryl Howell in Washington, D.C., ruled Friday the removal was “arbitrary and capricious” and violated the federal Endangered Species Act.

Unless overturned, her decision will block the states from scheduling additional hunting and trapping seasons for the predators. All three have had at least one hunting season since protections were lifted, while Minnesota and Wisconsin also have allowed trapping.

More than 1,500 Great Lakes wolves have been killed since federal protections were removed, said Jonathan Lovvorn, senior vice president of the Humane Society of the United States, which filed a lawsuit that prompted Howell’s ruling.

“We are pleased that the court has recognized that the basis for the delisting decision was flawed, and would stop wolf recovery in its tracks,” Lovvorn said.

“The science clearly shows that wolves are recovered in the Great Lakes region, and we believe the Great Lakes states have clearly demonstrated their ability to effectively manage their wolf populations,” Shire said. “This is a significant step backward.”

Wolf advocates applauded the ruling Friday.

“We filed the lawsuit to relist the Great Lakes population of wolves,” said Jill Fritz, coordinator of Michigan’s Humane Society of the United States. “It was based on the assertion that the Great Lakes states had proven they could not responsibly manage wolves when they were delisted in January 2012.”

Jodi Habush Sinykin, an attorney for Midwest Environmental Advocates, which supports science-based wildlife management, said the decision should serve as a clear signal of caution to people who would destroy the nation’s wolves.

Minnesota Natural Resources Commissioner Tom Landwehr said agency attorneys will study the ruling before determining its effect on state wolf policy.

“On face value we’re very surprised. We didn’t even know it was coming to a conclusion here,” Landwehr said. “It’s an unusual turn of events.”

This season has probably been the most abused hunting season since delisting, and they’ve all been bad – total disregard for quotas and the protection and continued thriving of a formerly threatened animal, which is what we were assured the states would do after they were “overly optimistically” delisted by the Federal government. In fact, some states have been bold enough to say they want to get rid of them entirely.

  7. A ray of hope! It amazes me how USFW has the name “wildlife” in their title when it should be United States Hunters and Ranchers Service.
    If left up to them, we would not have any predators left and only the species that made the states money.
    I will take this victory and hope that the wolves will stay endangered until the cattle ranchers sell all of their cattle and hunters hunt for food only.

  8. I witnessed the signatures of thirty-six scientists, begging the feds not to delist the most vital, necessary species in all of America’s ecosystems. Judge Howell reflects science. [Howell is also a family surname in my family.]

    A big win for America’s ecosystems, a big win for wolves, but especially an immense win for Mother Earth. I pray this is a big step toward the salvation and protection of America’s wolves, once again.

    If you define ‘manage’ as killing them off, then I guess this Mr. Gavin has a point. The wolves may have been ‘recovered’, and some of us have out doubts about that because the science doesn’t show it – but immediate hunting changed all that, especially the progressive escalation and now total disregard of quotas. This ruling corrects the significant step backward.

    The wolf (I have known one very well – through work and constant awakening to a greater extent than I have perceived in humans for over 50 years.     There are problems with the “Proposed Revision to the Regulations for the Nonessential Experimental Population of the Mexican Wolf” to which I direct you.

    Many people understand that the
    1. “experimental, Nonessential” 10j rule under which the Mexican wolf reintroduction will be conducted, is insufficiently protective of the Wolf in the area of NM and AZ proposed for its habitat. I haven’t personally disputed this, because I want these arid country wolves to return home, across the Southwest. You may take a stronger position, but there are also the following issues, which I regard as EXTREMELY IMPORTANT:
    2. The proposed area South of I-40 does not allow for genetic flow – connection to the Northern Rockies wolves, which historically existed before white persecution of wolves. There are few wolves from which the present Mexican wolves were bred, and this tiny original founding population must have this interaction to ensure what is called heterozygosity – enough different alleles and traits to handle whatever humans and the new changing climate throws at them – in perpetuity. Such a small population (300-325 is the goal) WILL trend toward homozygosity, sending them toward inbreeding depression and genetic failure.
    3. Biologists KNOW that the probable Minimum Viable Population is not 300, but more like a minimum of 4300 with some estimates (look em up on google scholar or in peer-reviewed MVP estimates) of 5200 to 7200. Their numbers are more specific, and may not be sufficient for a species that is monogamous and in which only 10% or so are reproducing individuals.

    4. So you need to tell them that their numbers are off (they know, and if you read the proposed ROD, you will find that they tell you right theere that they are proposing this insufficient number and habitat because of human social resistance (That’s fear and hate filled cattle and sheep people, and psychotic gun toy people – you have to have had seen some of the billboards and news ads about kids huddling in bis stops etc, to get the inanity of these Euroinvaders in NM and AZ.) Their numbers are off by a factor of about 20. The mxican wolf will not survive unless its population is allowed to recover to that 5 to 7 thousand.

    5. The Kaibab National Forest, the Coconino National Forest, – the Greater Grand Canyon Ecosystem, which includes much BLM land as well, the San Juan Mountains of S. CO (it too is a National Forest), the Mogollon Rim country connecting the present proposed range with these areas, the Guadalupe Mts extending into TX, are also suitable habitat.
    Southern Utah has now been shown to be a possible connection for genetic flow, because of the Northern Rockies female seen in Kaibab country.
